Public Offer
1. Public offer and acceptance
This document is a public offer (the “Offer”) for the provision of information and technology services via the Performer platform (the “Platform”).
You accept this Offer by taking any of the following actions: registering an account, creating a project, making a payment (funding a balance), or using the Platform features. From the moment of acceptance, this Offer forms a binding agreement between you and the payment recipient.

2. Definitions
“Client” means a user who creates a project and funds a project balance.
“Specialist” means a user who performs work within a project and records work sessions.
“Contract” means the agreement between the Client and a selected specialist within the Platform, including accounting of purchased and consumed hours.
“Project balance” means the Client’s prepaid funds available to pay for specialist work within the Platform.
3. How the Platform works and pricing
Each specialist sets their own hourly rate on the Platform.
Based on the Client’s request, the Platform can present relevant specialists, and the Client selects the specialist(s) for their project.
Before work starts, the Client purchases a number of hours as a prepaid package. The price is based on the specialist’s hourly rate and the Platform fee.
4. Payments
A Client may fund the project balance using: (1) payment card via WayForPay; (2) bank transfer to the recipient account based on an invoice.
Payments may be made in USD/UAH/EUR. If the payment currency differs, the payable amount may be calculated using an FX rate snapshot at the time payment details/invoice are created.
The final amount, currency, and order details are shown before payment confirmation and/or in the issued invoice.
5. Project balance and consumption
Paid funds are credited to the project balance and can be used without a time limit.
The project balance is consumed for completed billable work sessions under the contract within the Platform.
Once funds/hours are consumed (charged for completed work), they are considered used and are non-refundable.
6. Work sessions
Specialists record completed work time as work sessions. The Platform may apply automated billable-time classification and review.
Work and its payment require sufficient unused prepaid balance/purchased hours under the contract.
7. Termination and specialist change
The Client may terminate a contract with a specialist at any time within the Platform.
Any unused (unworked) part of the prepaid balance for that contract is returned to the project balance and may be used to pay any other specialist on the Platform.
Used hours (charged for completed work sessions) are not restored and are not refundable.
8. Refund policy
The Client may request a refund of unused funds remaining on the project balance. Only the portion that has not been consumed for completed billable work is refundable.
Refund requests can be submitted via the Platform UI or by emailing support@performer.so from the email address linked to the Client’s account.
After receiving a valid request and confirming the unused balance amount, we initiate the refund without undue delay and without unnecessary formalities.
Refunds are typically processed to the original payment method (card → card via WayForPay; bank transfer → bank transfer to the payer’s details).
The actual settlement time depends on banks/payment providers and may take up to 14 calendar days.
Any bank/payment-system fees (if charged) may be withheld according to the relevant provider’s rules and are outside the Platform’s control.

10. Other terms
This Offer and the parties’ relationship are governed by the laws of Ukraine.

The Platform may update this Offer from time to time by publishing a new version on the website. Continued use of the Platform after updates are published constitutes acceptance of the updated Offer.
